With regard to the principle of free movement of persons, goods and services within the entire EU area, the EEA and the Swiss Confederation, a number of measures and regulations have been adopted in healthcare.

One of the most important regulations, governing the rights of patient access to healthcare services during their stay of an insured person in another Member State, is Regulation (EC) No 883/2004 of the European Parliament and of the Council of 29 April 2004 on the coordination of social security systems (Text with relevance for the EEA) (and old Regulation (EEC) No 1408/71 of the Council of 14 June 1971 on the application of social security schemes to employed persons and their families moving within the Community).

This Regulation relates to “required medical treatment” and “referral for medical treatment” in another Member State.  In addition, the provisions of this Regulation relate to access to healthcare services for migrant workers, pensioners and members of their families.
